MCS’ Steven E. Kennedy to host live webinar on Texas mechanic’s lien strategies and statutory updates

McGuire, Craddock & Strother’s Steven E. Kennedy will host an October 14 webinar to address recent changes to the Texas mechanic lien framework, an area of Texas construction law widely considered to be one of the most complex in the country. The head of MCS’s Construction Law section, Steve has coauthored two of the definitive books on Texas mechanic’s and materialman’s lien statutes.

The live webinar is designed to provide insight into mechanic’s liens and recent statutory changes to the law for executives, construction managers, project managers, architects, engineers, contractors, subcontractors, lending professionals, business owners and managers, developers, controllers and accountants.

Topics covered in the webinar will include:
• Required steps for securing payment through a mechanic’s lien.
• Limitations of lien claims and ways to effectively dispute improperly filed or asserted claims. In addition, the webinar will address the importance of providing prompt notice of claims and the statutory language required to make those notices effective.
• Key deadlines.
• Scenarios in which personal liability can arise based on the receipt of construction payments and the failure to pay subcontractors and suppliers out of those funds.
• A review of new Texas requirements for filing forms used to effectively waive lien rights upon payment or the promise of payment. In addition, the webinar will explore how to use these new forms, as well as some of the problems inherent in the language now required by statute.
