Commentary by McGuire, Craddock & Strother’s Steve Thomas Featured in Texas Lawyer
In a commentary published in Texas Lawyer, McGuire, Craddock & Strother’s Steve Thomas highlights how sensitive documents and data leaked by Eric Snowden should serve as a wake-up call for lawyers and law firms. The trove of leaked information includes disclosures that a U.S. law firm involved in international litigation has been the subject of government surveillance of its email and electronic communications.
Writes Thomas: For now, lawyers might need to inform their clients of the risks and discuss possible alternatives to unencrypted email for particularly sensitive communications. But until courts, ethics commissions or the ABA opine further on the subject, lawyers at least need to be wary of electronic methods they use to communicate client confidences.
