Barry concentrates his practice on businesses, employment law, and construction litigation in federal and state courts. He also brings his experience in partnership and business disputes to assist family law attorneys with certain matters where large business interests are at stake. Barry thrives in high stakes litigation where time is of the essence and decisive action must be taken quickly and efficiently in order to protect his clients’ sensitive business interests. He also works closely with his clients before problems arise to find creative ways to protect their most vital resources and to assist them in avoiding litigation if at all possible.

Barry began his legal career as a law clerk for the Honorable Nathan B. Coats of the Colorado Supreme Court. He also served as a law clerk to United States Senator John Cornyn of Texas. He earned a B.S. in civil engineering from Texas A&M University in 1999, where he was a member of the Texas A&M Corps of Cadets and served as a company commander. Prior to law school, he worked as a civil engineer in Texas and Colorado where he managed and designed engineering projects from preliminary feasibility through final construction for residential, commercial, and “big box” type developments. Barry earned his J.D. in 2004 from the University of Denver Sturm College of Law, where he graduated in the top 3 percent of his class, served as the Editor-in-Chief of the Denver University Law Review, and received numerous awards for scholastic excellence, student leadership, and academic achievement.

In addition, Barry is named to the Texas Rising Stars list by Thomson Reuters as published in Texas Monthly.

Representative Experience

  • Defended several joint property owners in defense of multimillion dollar claims for breach of contract and fraud in connection with the marketing and sale of real property.
  • Represented owners and general contractors in lawsuits involving negligence claims, breach of contract, and defective construction.
  • Defended and prosecuted former employees of healthcare providers for breach of noncompetition agreements, misappropriation of confidential information, theft of trade secrets, and breach of fiduciary duties where the healthcare providers had taken sensitive business information such as patient lists, employees, and other confidential information and trade secrets.
  • Defended and prosecuted former executives who had left their former companies and taken vital confidential information and trade secrets that belonged to the business or partnership.
  • Defended numerous companies in discrimination, retaliation, and harassment claims for violations of Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), and the Age Discrimination in Employment Act (ADEA).
  • Defended employers and business owners in various governmental investigations including Department of Labor investigations, U.S. Securities and Exchange Commission investigations, and claims brought before the Equal Employment Opportunity Commission (EEOC).
  • Prosecuted and defended employee FLSA wage and hour claims including class action lawsuits for failure to pay overtime wages.
